CSR and Inclusivity

We believe that access to legal rights, and the ability to assert them, should be available to all, without distinction based on gender, age, sexual orientation, disability, religion, culture or other aspects of identity and diversity. Our work in inclusivity rests on one commitment: to help individuals and families understand, assert and protect their rights, and to guide them through the legal system with confidence, discretion and care. We combine attention to the statutory and regulatory framework with an understanding of the practical barriers that often decide whether a legal right can be exercised at all.

Disability Rights and Accessibility

We advise individuals, families, organisations and institutions on disability rights and accessibility, including:

-rights and entitlements under the Rights of Persons with Disabilities Act, 2016;

-disability certification and related documentation;

-reasonable accommodation and accessibility in educational and workplace settings;

-accessibility in public and private spaces;

-legal guardianship and decision-making arrangements for persons with intellectual and developmental disabilities; and

-adoption involving children with disabilities, including the interaction between the Juvenile Justice Act, 2015, CARA processes and disability rights.

We also represent clients before the relevant forums, including the Chief Commissioner for Persons with Disabilities and the State Commissioners for Persons with Disabilities.

LGBTQ+ Rights

We advise LGBTQ+ individuals and couples on the legal issues involved in organising their personal and family affairs, including:

-succession and inheritance planning;

-adoption and parenting arrangements;

-surrogacy and assisted reproduction;

-cohabitation and relationship arrangements;

-property and financial planning between partners; and

-planning for circumstances where Indian law may not recognise a relationship in the same way as marriage.

We also assist transgender clients with recognition, documentation and entitlements under the Transgender Persons (Protection of Rights) Act, 2019. Our focus is on protecting a client’s interests within the legal framework as it exists, including where the law does not yet provide direct recognition or protection.

Senior Citizens’ Rights

We advise and represent senior citizens and their families in matters concerning welfare, maintenance, property and family responsibility, including:

-proceedings for maintenance under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007;

-property and residence-related disputes;

-neglect and elder abuse; and

-planning for the management and transfer of assets.

These matters often involve more than a legal dispute. We therefore consider the wider family, property and financial circumstances when advising on the course of action.

Personal Philanthropic Structuring

We advise individuals and families who wish to structure their philanthropic or charitable giving in a planned and lasting manner. This may include:

-establishing private trusts and other charitable structures;

-advising on governance and administration; and

-cross-border philanthropic arrangements, including issues arising under the Foreign Contribution (Regulation) Act, 2010.

Inclusivity law often sits at the intersection of different areas of law. A question about a person’s rights may also involve family law, succession, property, disability law, regulatory requirements or institutional processes. We give practical advice suited to the client’s circumstances: we identify the legal options available and develop solutions that work in the situation at hand.
